These Terms of Service (the "Terms") govern your use of OffshoreServ. By creating an account, ordering, or using any service, you agree to them. Please read them together with our Acceptable Use Policy, Privacy Policy, DMCA & Complaints Policy, and Service Level Agreement, which form part of this agreement.
1. Parties
This agreement is between you, the customer, and the operating entity that runs OffshoreServ ("we", "us", "OffshoreServ"). The name and registered address of the operating entity are provided on request. You are the person or organization that holds the account, orders the service, and is responsible for its use and payment.
2. Your account
An account requires only an email address, which may be private or disposable, and a password. You do not give us your name, address, phone, or identity documents. The
- You are responsible for everything done through your account and services.
- You are responsible for the security of your account credentials and of the access details (such as SSH keys, root, or administrator passwords) to your servers. You can turn on
two-factor authentication with an authenticator app (TOTP), and we recommend it. - No password reset. There is no
email-based reset, and because we hold no identity documents, we cannot verify you any other way: a lost password, or a losttwo-factor device without its setup key, cannot be recovered. Keep your password in a password manager. - Your email address is only your login: we never send email to it, marketing or otherwise. Support replies, service notices, renewal warnings and legal notices appear in your client area, so sign in regularly.
- You can close your account from the client area once nothing is running on it. Closing it removes your email address and login data; billing records are kept without your email, as accounting requires. Any balance left on the account is forfeited when it is closed, so use it first, or withdraw the part that can be sent back under section 6.
3. Ordering and provisioning
You order from the Deploy page of a server while signed in to your account; there is no guest checkout. When you confirm an order, the price of the billing cycle you chose is paid at once from your account balance, and provisioning starts immediately. Typical delivery times are:

These are typical times, not guarantees. Access details (IP address, username, and password) appear on the service's page in the client area; they are not sent by email. If provisioning takes longer than the stated range, we tell you on the service's page in the client area.
Some plans and locations depend on stock. Where a dedicated or GPU configuration is temporarily unavailable, we will tell you in your client area and either hold your order until stock returns or return the payment to your balance. IP addresses are assigned by us and remain ours; we may need to change an assigned IP address for operational or legal reasons, and we give notice in your client area where practical.
4. Payment and your balance
Prices are shown in USD. Every account has a balance in USD, which you top up in cryptocurrency from the client area (

- Underpayment. If you send less than the amount shown, the payment page shows what is still due. Send the rest before the payment expires.
- Late, expired and overpaid payments. A transfer that arrives after the deadline is usually still detected and credited automatically. If it is not, if a payment expires before it is complete, or if you send more than the amount shown, report it from the payment's page in the client area (Billing) with the transaction ID. We check the blockchain and credit what arrived to your balance.

Network (miner) fees for sending crypto are yours to bear, both when you top up and when we send funds back to you. Prices are shown exclusive of any taxes that may apply to you in your own jurisdiction, and you are responsible for any such taxes. We charge no setup fees.
5. Renewals, suspension, and data deletion
Services renew on your billing cycle (monthly, quarterly, or yearly). Each renewal is charged automatically from your balance on the due date; there are no renewal invoices and no reminder emails. The client area shows your upcoming renewals and warns you when your balance is short. You can switch automatic renewal off for a service, or set it to cancel at the end of its period: it is then not renewed, and its data is deleted after the end date.
If a renewal is not paid by the due date, for example because your balance is short or automatic renewal is off, we follow fixed steps:
- Suspension. The service is suspended
3 days after the due date. - Data deletion. If the service stays unpaid after suspension, data is deleted:
14 days after suspension for VPS and RDP; and7 days after suspension for dedicated and GPU servers, so the hardware can be returned to inventory.

Network availability and service credits are governed by our Service Level Agreement, which targets 99.9% monthly network availability and sets out how to claim credits. Credits are added to your balance. The SLA is your exclusive remedy for downtime.
10. Your responsibilities
You are responsible for how you run your server. In particular:
- Backups. Keep your own backups. We are not your backup provider, and we are not responsible for lost data, including after suspension and deletion under section 5.
- Security. Keep your server patched and hardened and your credentials safe. A compromised customer server is your responsibility, and you remain liable for activity originating from it. See our hardening guide.
- Lawful use. Ensure your use is legal in the server's jurisdiction and complies with the AUP.
- Your customers and users. If you resell or host others, you are responsible for their conduct on your service.
- Lawful export and sanctions. You are responsible for ensuring your use complies with any
export-control or sanctions rules that apply to you.
11. Liability limits
We provide the service with reasonable skill and care, but to the fullest extent permitted by law:
- The service is provided "as is" and "as available". We do not warrant that it will be uninterrupted or
error-free beyond the commitments in the SLA. - We are not liable for indirect, incidental, special, or consequential loss, including lost profits, lost revenue, or lost or corrupted data.
- Our total liability for any claim relating to a service is limited to the amount you paid us for that service in the
3 months before the event giving rise to the claim. - Nothing in these Terms excludes liability that cannot lawfully be excluded.
11.1 Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless against claims, losses, and reasonable costs arising from your content, your use of the service, or your breach of these Terms or the Acceptable Use Policy, including claims brought by third parties or your own users.

We may update these Terms. The date at the top shows the current version. For material changes, we give notice at least

If any provision of these Terms is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your account to another person without our agreement. These Terms, together with the policies they reference, are the entire agreement between you and us for the service.
We are not liable for any failure or delay caused by events beyond our reasonable control, including failures of networks we do not operate, attacks beyond our mitigation capacity, natural events, or the acts of governments and authorities.
