Malaysia sits outside the European legal space, so neither the Digital Services Act nor the GDPR is local law for a server in Kuala Lumpur. Malaysian law applies instead, and it differs from the European model in two directions: copyright complaints follow a detailed statutory procedure, and speech is more tightly regulated.

Article 10 of the Federal Constitution guarantees freedom of speech but lets Parliament restrict it. RSF ranks Malaysia 95th in 2026, down from 88th, citing the Sedition Act, the Official Secrets Act and the use of the Communications and Multimedia Act against content labeled fake news. Freedom House rates internet freedom as Partly Free (60 of 100) and notes the Online Safety Act 2025, under which platforms must reduce users' exposure to harmful content and the Malaysian Communications and Multimedia Commission (MCMC) enforces that duty. Section 3(3) of the Communications and Multimedia Act 1998 states that nothing in it permits censorship of the internet, yet Freedom House reports that the MCMC regularly has content removed and websites blocked.

The copyright notice procedure

Part VIB of the Copyright Act 1987, in force since 1 March 2012, gives service providers safe harbors in exchange for a statutory notice procedure:

• A copyright owner may notify the provider in the form the Minister prescribes and must undertake to compensate the provider for losses caused by complying (section 43H(1)).
• The provider must remove or disable access to the infringing copy within 48 hours (section 43H(2)) and inform the person who made it available, with a copy of the notification (section 43F).
• That person may send a counter-notification. The material is restored no sooner than ten business days later, unless the complainant reports that it has filed for a court order (sections 43H(3) to 43H(5)).
• Knowingly false statements in a notification are a criminal offense, punishable by a fine of up to RM100,000, up to five years in prison or both, plus liability for damages, even when made from outside Malaysia (section 43I).

Since 2022, section 43AA has also made it an offense to commit or facilitate infringement by selling, distributing or offering streaming technology or services, with prison terms of up to 20 years.

Data protection and retention

The Personal Data Protection Act 2010 covers personal data processed in commercial transactions; it does not bind the federal or state governments. The Personal Data Protection (Amendment) Act 2024 took effect in phases during 2025 (DLA Piper). Data processors now carry direct security obligations, "data users" became "data controllers", biometric data counts as sensitive data, and cross-border transfers are allowed where the destination has substantially similar law or an equivalent level of protection. Data protection officers and mandatory breach notification followed from 1 June 2025, and the amendments also add a right to data portability. The regulator is the Personal Data Protection Commissioner.

Malaysia has no EU adequacy decision. If the GDPR applies to your processing, storing personal data in Kuala Lumpur is a transfer to a third country and needs a safeguard such as standard contractual clauses.

Malaysian law sets no EU-style retention period that makes hosting providers store traffic data. Licensed network operators have statutory duties to assist the authorities, and police and regulators can compel disclosure of data a provider already holds. What we keep is set out in our privacy policy: your email address, your balance and payment records, your sign-in sessions (browser and country, never the IP address) and your service records. We do not log or inspect the traffic on your server.

Malaysia is not in the Five, Nine or 14 Eyes intelligence-sharing groups. Those groups share intercepted communications; data on a server in Kuala Lumpur is still obtained through Malaysian procedures, as our guide to what the 14 Eyes mean for hosting explains.

How we handle complaints here

1. Every complaint about a server in Kuala Lumpur is logged and checked against Malaysian law.
2. A US DMCA notice is answered, not enforced. It is not a section 43H notification and has no legal force here, so nothing happens to your server.
3. A valid order of a Malaysian court can require action, and so can a copyright notification that meets section 43H, which gives the provider 48 hours to disable the material. We forward such a notice to you as soon as it arrives, so you can respond, remove the material yourself or prepare a counter-notification, unless a court forbids disclosure.
4. Requests and outcomes are published in our quarterly transparency report, without customer data.

Network and latency

Malaysia is a major landing country for Asian subsea cables. TeleGeography lists 24 systems in service with landings in Malaysia, and more planned. They include SeaMeWe-4 and SeaMeWe-5 toward the Middle East and Europe, AAE-1 to Europe via the Middle East, the Asia-America Gateway toward the United States, and APG toward East Asia. Domestic peering happens at MyIX, the Malaysia Internet Exchange association.

In a straight line, Kuala Lumpur is about 310 km from Singapore, 2,500 km from Hong Kong and Manila, 5,300 km from Tokyo and 6,600 km from Sydney, while Frankfurt is about 10,000 km away.
