US DMCA notices: not actioned

# DMCA-ignored hosting, done by the book.

A US DMCA notice has no legal force in Iceland, Switzerland, Moldova, Romania, the Netherlands, Bulgaria or Malaysia. We answer it with our policy and your server stays online. What *can* require action is written down: a court order from your server’s country, or a valid EU notice in EU locations.

## What happens to a DMCA notice.

The same four steps for every notice, in every jurisdiction.

1. **We receive it** — Notices arrive through our online report form. Each one is logged and read by a person.
2. **We check the law** — Is it enforceable in the country where your server runs? For a US DMCA notice, the answer is no.
3. **We answer the sender** — We reply with our policy. The notice is not forwarded to you as a takedown, and your server stays online.
4. **We publish the count** — Every notice is counted in our quarterly [transparency report](https://offshoreserv.com/transparency-report), without customer data.

### Is DMCA-ignored hosting legal?

Yes. The DMCA is a US law; it binds US providers, not hosts operating in other countries. We follow the law of each server’s jurisdiction instead. You remain responsible for obeying the law that applies to you and to your content.

### Will you forward DMCA notices to me?

We may let you know that a notice arrived, for your information. It is never a takedown request, and you do not need to act on it.

### What about the EU locations?

In Romania, the Netherlands and Bulgaria, the EU Digital Services Act applies: a precise, substantiated notice about illegal content must be assessed and can lead to action. Iceland, Switzerland, Moldova and Malaysia are outside the DSA.

### Can a court still order my site offline?

Yes, a court in your server’s country can. That is the rule we follow and publish. We inform you first unless the order forbids it, and the request appears in our transparency report.

### What is never allowed?
